Olive Judd, P.A. Secures Pivotal Appellate Victory – Vuletic Group, LLC v. Malkin
An Olive Judd team led by attorneys Ben Olive and Khaleel Martin successfully secured the reversal of an improper final judgment against its client. Olive Judd represented a business that remodeled a multimillion-dollar home in the South Florida Area. The homeowners filed claims for allegedly defective work, amongst other things, and sought nearly $500,000 in damages. The 15th Judicial Circuit awarded the homeowners’ damages; however, the damages were improperly measured after the date of the alleged breach.
Olive Judd raised this issue to the 4th District Court of Appeal and obtained a reversal of the final judgment. Specifically, the 4th DCA agreed with Olive Judd’s arguments and held that the trial court erred in awarding the homeowner’s damages.
In summary, we find that the homeowners were required to prove their damages as of the date of breach. Since the homeowners did not present evidence of damages as of the date of breach and failed to meet their burden, we reverse and remand with instructions for the trial court to enter judgment in Vuletic’s favor.
